On a minimal monthly retainer fee, we provide the following services:

Unlimited representation at the CCMA and Bargaining Councils

As soon you receive a referral from the CCMA or Bargaining Council, please inform us. We can then schedule a consultation with you in according with the referral date of the instructing body. During the consultation, we will take notes, assess the evidence, manage the possible collection thereof, and take necessary statements from possible witnesses if required. We also advise on the most likely outcome and any settlement or terms that can be used during negotiations at any pre-conciliation meeting or other informal procedures (such as mediation or arbitration at the CCMA). If there is no solution or meeting between the affected parties, the matter will likely be referred for arbitration. This is a more formal process during which time a commissioner will make a final decision (in the form of an award).

Advice and support on all legislation, Bargaining Council terms, and disciplinary matters and procedures

If you have any questions regarding any of these matters, please contact us to provide the required advice. Maybe you need a change in company policy or disciplinary code. We do the required research on the matter and provide you with precedent.

Facilitating and chairing of disciplinary hearings, appeals, and private arbitrations

Facilitating and chairing of disciplinary hearings, appeals, and private arbitrations Hearings of this nature require independent and objective professionals to chair. We provide professional arbitrators and advocates in this regard. Furthermore, we can also provide the initiator if so requested. The Labour Resolution Company – PTY (Ltd) has boardrooms available at its offices in Alberton, Johannesburg (see the last point).

Use of our boardrooms and meeting rooms in respect of our services

We have made our facilities available for disciplinary hearings, statutory consultations, and wage and union negotiations. These facilities are used on a booking system in conjunction with all our services. This makes it an ideal solution for businesses who are service-based and not venue-based and therefore do not have the facilities for such matters.

The Department of Labour regulate these types of consultations. As such, they have very specific procedures that need to be followed. We can assist you every step of the way with utmost efficiency when it comes to procedural and substantive compliance.

Drafting of required documents, policies, notices, and employment contracts

We can assist you draft any document you may require, for example an HIV or even telephony policy. It is essential that your organisation can produce proper documentation when it comes to employee notices, especially when it comes to disciplinary actions.

Union and strike consultations

It can be very stressful when employees are trying to unionise in your workplace. This requires expert guidance on preventing work stoppages and any potential financial losses. Fortunately, unions are regulated. So, before any dialogue with one is begun, please come and consult with us in advance.

Restructuring, and transfer and wage negotiations

Whether selling, buying, or merging business ventures, the utmost diligence is required when it comes to the factors impacting employees. Alignment of salaries and the nuts and bolts of physically incorporating new staff must be conducted with the correct procedural requirements. This must also take place within the legislative framework. The Labour Advocate can schedule all required consultations and brief the business on the most effective course of action to implement the required processes.

Afiswitch criminal checks

The Afiswitch system interfaces with the South African Police Service Automated Fingerprint Identification System (SAPS AFIS) for the purpose of criminal background checking. We manage the checking process on behalf of our clients to verify any possible previous convictions. It takes approximately 24 hours to get a hit. In such a case, the file is requested to view the specific information. In the event of a previous conviction, it can take up to four weeks to obtain the file.

Polygraphs and investigations

Polygraph testing can be arranged for pre-employment or fraud and theft investigations. We work with senior professional fraud and theft investigators that can facilitate investigations to form the basis for either criminal prosecution or civil litigation.
